The appeal of Mister Sani Yahaya of the New Nigeria Peoples Party (NNPP), who is contesting the election of PDP nominee Kefas Agbu as governor of Taraba state, has been denied by the Court of Appeal in Abuja.
Yahaya and his party contend that Agbu did not get the majority of legal votes cast, and they have challenged the results of the March 18 governorship election on the grounds of violation with the Electoral Act.
However, in a ruling on Tuesday, the appeal court determined that the NNPP candidate’s requested reliefs were contradictory, as he had criticised the poll results for violating the Electoral Act, but he had also asked the court to declare him the victor of the same contest.
The NNPP’s appeal was thus denied by the court in a unanimous ruling for lack of merit, as the Tribunal had done on September 30.
In the March 18 governorship election, governor Agbu received 257,926 votes to defeat governor Yahaya, who received 202,277 votes.
On the grounds of breaking the Electoral Act of 2022, the petitioners had filed a suit against the PDP and its candidate, Kefas Agbu. They had cited allegations of violence in certain polling places, overvoting, and result sheet mutilation.
