Mr. Tonye-Cole’s case arose as a result of the Appeal Court’s decision on November 28th, which rejected his appeal due to insufficient and convincing evidence.
The main argument put forth by the APC governorship candidate is centered around irregularities, non-compliance with the Electoral Act, and Fubara’s continued involvement as the Rivers State’s Accountant-General despite being nominated as the governorship candidate of the People’s Democratic Party (PDP).
Patrick Tonye-Cole’s appeal is directed towards the Independent National Electoral Commission (INEC), the PDP, and Governor Fubara. A panel of five members, led by Justice Kudirat Kekere-Ekun, has reserved judgment on the appeal after all parties involved in the case presented their arguments.
Additionally, the apex court dismissed the appeal of Innocent Kere from the Allied People’s Movement (APM) after it was voluntarily withdrawn by his legal representative.
