Shettima’s selection as Tinubu’s running mate, according to the PDP, violated the Electoral Act of 2022.
In a case seeking to have Bola Tinubu and Kashim Shettima disqualified from running for president and vice president of the All Progressives Congress (APC), respectively, the Supreme Court has set a hearing date of May 26, 2023.
The PDP said that Shettima’s selection as Tinubu’s running mate violated the terms of sections 29(1), 33, 35, and 84(1)(2) of the Electoral Act 2022 in the lawsuit filed on July 28, 2022.
The party claimed that Shettima’s nomination to run for vice president and the Borno Central Senatorial District seat at the same time was illegal.
The PDP also asked for an order to invalidate Tinubu, Shettima, and the APC’s eligibility to run in the presidential election.
However, Justice Inyang Ekwo of the Federal High Court rejected the lawsuit on the grounds that the PDP lacked locus standi to bring the lawsuit.
The PDP challenged the verdict because it was not pleased.
The PDP failed to prove that it had locus standi to bring the lawsuit, according to a three-member panel of the Court of Appeal chaired by Justice James Abundaga, who delivered the ruling in the appeal.
Abundaga characterized the PDP as a nitpicker who meddled in APC internal matters.
Due to the PDP’s inability to demonstrate its locus standi, the court rejected the appeal.
