A Peoples Democratic Party (PDP) chieftain named Chief Daboikiabo Warmate has sued Amb. Umar Damagum, the party’s acting national chairman, for allegedly violating the party constitution.
The National Working Committee (NWC) and National Executive Committee (NEC) of the party were also implicated by Warmate, who is also the head of the Concerned PDP League (CPDPL).
The lawsuit was filed with the following designations: FCT/HC/GAR/CU/417/2023, FCT/HC/GAR/M/1068/2023, and RN 12936423.
Warmate claimed that section 31 subsection 4 of the PDP 2017 constitution as amended was disrespected, disregarded, and thrown out of the window by the interim chairman, NWC, and NEC.
According to him, the clause states that “the NEC shall meet at least once every quarter at the initiative of the National Chairman or upon the request of two-thirds of its membership, who shall notify the Chairman at least seven days prior to the meeting; and an emergency meeting may be called by the National Chairman having regard to all the circumstances of the agenda.”
He said that no such meeting had been held since the 97th NEC conference, which was held on September 8, 2022.
According to Warmate, there are 12 months in a year, which equals four quarters, while according to the Gregorian calendar, three (3) months make up one quarter.
As a result, he requested a court injunction prohibiting the acting chairman, the NWC, and the NEC from engaging in any future party activity.
Additionally, he requested that a NEC meeting be called within seven days in order to elect, nominate, fill, or confirm the National Chairman in Acting Capacity to a substantive National Chairman, the National Secretary, and other party leaders whose posts are vacant.
The PDP chairman also asked the court to issue an order requiring the first through third defendants to pay a total of five million naira as court costs and other related expenditures.
