The Court of Appeal has given the Labour Party’s Peter Obi permission to serve All Progressives Congress candidate Bola Tinubu with his petition contesting the February 25 presidential election (APC).

In an exparte plea, the LP flag bearer’s solicitor, Ikechukwu Ezechukwu (SAN), requested that the appellate court allow Obi and the Labour Party permission to serve the petition on Tinubu and the Vice President-Elect, Kashim Shettima, via other methods.
Due to increased security around the president-elect and vice president-elect, Ezechukwu said it was essential to serve the court documents to Tinubu and Shettima using “substituted methods.”
The attorney requested that the court allow Obi to deliver court papers to Tinubu and Shettima via the APC’s legal counsel’s office.

Obi’s plea was approved by a three-member bench of the Court of Appeal, Abuja, which was chaired by Haruna Tsammani.
The court ruled that Tinubu and Shettima must receive notice of the petition “by delivering…or pasting the petition No:CA/PEPC/03/2023 and all other processes filed in the petition at either the office of the National Legal Adviser of the APC” or…with any other officer of the APC “at its National Secretariat at No.40 Blantyre Street, Off Ademola Adetokunbo Crescent, Wuse 2, Federal Capital Territory, Abuja.”
Mr. Obi observed in the ex parte motion that the Court of Appeal bailiff made “unsuccessful attempts to serve the petition directly on” Messrs. Tinubu and Shettima.
