The legal team representing Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), has lodged an appeal with the Court of Appeal against the ruling of the Abuja Federal High Court.
Aloy Ejimakor, the lead counsel for Kanu’s legal team, expressed their dissatisfaction with the decision made by Justice Binta Nyako on March 19, 2024.
The team argued that the lower court had erred in denying Kanu his constitutional right to a fair trial.

They also highlighted the Department of State Services’ failure to provide adequate facilities for the preparation of Kanu’s defense and his right to choose his own counsel, which they believed resulted in a serious miscarriage of justice.
In the notice of appeal filed by Ejimakor, it was stated that the trial court had wrongly assumed jurisdiction to proceed with the criminal trial against Kanu despite the blatant denial of his right to a fair trial and the necessary resources to prepare his defense.
The team emphasized that a fair hearing and trial are fundamental constitutional rights that ensure the accused is given sufficient facilities to prepare their defense.
The denial of Kanu’s opportunity to interact and brief his counsel on the defense strategy he intends to pursue in the trial court was seen as a significant violation of his rights.
