Kwankwaso removed from office by appeal court

Musa Ilyasu Kwankwaso of the All Progressives Congress (APC), who was serving as a member of the House of Representatives for the Kura/Madobi/Garun Malam Federal Constituency, has been dismissed by the Court of Appeal in Abuja.

Yusuf Umar Datti, the candidate for the New Nigeria Peoples Party (NNPP), was reinstated by the appellate court.

The three-judge panel, presided over by Justice Tunde Oyebamiji Awotoye, upheld Datti’s appeal in its ruling.

The appellant’s resignation date was incorrectly counted by the tribunal on the day of his party’s primary election, according to Justice Awotoye’s ruling.

The judge observed that the Electoral Act’s Section 77 had been implemented incorrectly. As a result, no court has authority to hear cases involving party membership.
