Kano Guber: APC files an appeal against a controversial court judgement

The All Progressive Congress (APC) has challenged the Court of Appeal’s decision to not bar Kano State Governor Abba Yusuf from running for office due to suspected certificate fraud in a two-ground cross-appeal to the Supreme Court.

Two grounds were given by the party in its cross-appeal in the appeal notice submitted on Wednesday by Akin Olujinmi, the attorney for the APC.
“On page 11 of the ruling, the Lower Court made a legal error while ruling as follows:

“The cross-appellant has no practical benefit or value from whether or not the 2nd Cross Respondent’s Form EC9 exhibit qualifies as a certificate under Section 182[1] [j] of the Federal Republic of Nigeria, 1999 [as amended],” Olujinmi stated.

“Contrary to the holding of the lower court, a decision on it goes to the issue on non-qualification of the 2nd cross-respondent to contest the election in dispute in this appeal,” Olujinmi continued, citing specifics of the mistakes in the ruling.

On the other hand, the APC requested that the Supreme Court grant permission for the cross-appeal.

Remember that the ruling of the Kano State Governorship Election Petition Tribunal was upheld a few weeks ago by the Court of Appeal?

The Kano governor’s race on March 18 was pronounced won by APC candidate Nasiru Gawuna, according to the court.

However, four days later, the certified real copy of the verdict was disclosed, in which the appeal court partially overturned its earlier ruling.
