The Peoples Democratic Party (PDP) governorship candidate, Isah Mohammed Ashiru, filed an appeal with the Court of Appeal in Abuja, contesting the election of the All Progressives Congress (APC) governor of Kaduna State, Uba Sani. The appeal was dismissed.
In a ruling on Friday, the Court ruled that the Kaduna state governorship election on March 18 was definitive and upheld Uba Sani as the election’s legitimate victor.
The Kaduna State Governorship Petition Tribunal’s ruling on September 28 that the election was inconclusive was overturned by the Appellate Court in its decision.
The three-member justices’ ruling on the main and cross appeals was delivered by Justice Obietonbara Owupele Daniel-Kalio, who also overturned the tribunal’s directive to the Independent National Electoral Commission (INEC) to hold supplementary elections in 22 polling places across the state’s four Local Government Areas.
In the primary appeal, Justice Daniel-Kalio addressed each of the five points raised against the Peoples Democratic Party (PDP) and Mohammed Isah Ashiru, the party’s nominee for governor in the 2023 election.
The five concerns concerned purported irregularities, excessive voting, election outcome manipulation, and ballot box stuffing by the PDP and its candidate for governor.
