Fresh order issued by the court restrains NLC and TUC from further strike in Imo

After hearing the arguments made by the attorneys for both parties that they had not yet reached a resolution to their disagreement, Justice Nelson Ogbuanya issued the order on Friday, October 3.

A new temporary order prohibiting organised labour from going on strike in Imo State until further notice has been issued by the National Industrial Court, which is seated in Owerri.

The court issued a warning, stating that disobeying its order would have repercussions.

After hearing the arguments made by the attorneys for both parties that they had not yet reached a resolution to their disagreement, Justice Nelson Ogbuanya issued the order on Friday, October 3.

The Trade Union Congress and Comrade Nuhu Toro, its secretary general, as well as the Nigeria Labour Congress and Comrade Emmanuel Ugboaja, its secretary general, are the defendants.

The Imo State Government and the Attorney General of Imo State are the plaintiffs in lawsuit No. NICN/OW/41/2023.

After hearing from both attorneys and evaluating the claimants’ request for an interlocutory injunction, the court decided to postpone its decision until November 30, 2023.

The court further said that it is its responsibility to prevent the labour dispute and associated disputes between parties from getting worse and negatively affecting the interests and welfare of the general public as well as other parties who are not parties to the labour dispute. The court ruled that the parties must maintain peace until the next postponed date because the case has already been filed for decision in the ongoing lawsuit.

The court ordered the parties involved in the ongoing lawsuit to consider the repercussions of disobeying the current court order.

In order to make a decision about the claimants’ interlocutory injunction, the court postponed the case until November 30.
