Hon. Idris Dan Kawu of the New Nigerian Peoples Party (NNPP) has been re-instated as the elected representative of the Kumbotso federal constituency in Kano state by the Appeal Court Division in Abuja Federal Capital.
This indicates that the Election Petition Tribunal’s decision to dismiss Kawu and name All Progressives Congress candidate Mannir Babba DanAgundi as Kumbotso’s representative in the National Assembly was overturned by the Appeal Court.
Judge Tunji Oyebamuji led a three-member panel that rendered a decision on Wednesday, finding that the lower court erred in prioritising the ruling on Idris Kawu’s certificate even though he had not submitted it to the Independent National Electoral Commission (INEC).
Additionally, the Court of Appeal decided that the lower court erred in its decision to base its decision on witnesses who had been subpoenaed.
Furthermore, the court maintained that Mannir Babba Danagudi had not produced trustworthy witnesses to support the nullification of Idris Dankawu’s election victory in the Kumbotso Federal Constituency.
