The case was postponed until May 12, 2023, when the move on notice will be heard by the court.
The Minority Leader of the House of Representatives, Alhassan Ado Doguwa, has been charged with murder, and the Kano State High Court has approved an ex-parte application seeking permission to begin an Order of Mandamus that will require the state’s Attorney General, Musa Abdullahi Lawan, to do so.
The action was taken in response to claims that Doguwa was behind the killings and arson attacks at Tudunwada Local Government Area on February 25 during the presidential and National Assembly elections.
Muntari Garba Dandago, a retired chief magistrate in the state, requested permission from the state high court to apply for an order of mandamus in an effort to compel Doguwa and other accused conspirators to be charged right away.
In her decision, Justice Maryam Sabo stated: “Leave is hereby granted to the Applicant to apply for the issuance of an order of mandamus against the respondent, that is Attorney General of Kano State, compelling him to exercise his power under Section 211 of the Constitution of Federal Republic of Nigeria (as amended) to immediately file a charge against Doguwa and his conspirators.”
Musa Abdullahi Lawan, the attorney general for Kano State, responded to the development by declaring, “We have nothing to hide with the issue concerning the legislator. The Ministry would take the required steps as soon as the case file was returned.
Civil society organizations in the state claim that the state administration was reluctant to press charges against the federal lawmaker because he is a member of the ruling All Progressives Congress (APC), which is the cause of the case’s delay.
The case was postponed until May 12, 2023, when the move on notice will be heard by the court.
