Nnamdi Kanu’s request to have Justice Nyako removed from his trial has been rejected by the Chief Judge, reaffirming Justice Nyako’s continued oversight of the high-profile case.
The Chief Judge of the Federal High Court, Justice John Tsoho, has rejected Nnamdi Kanu’s request for Justice Binta Nyako to recuse herself from his case. Nnamdi Kanu is the leader of the banned Indigenous People of Biafra (IPOB).
Justice Tsoho confirmed Justice Nyako’s position in the case, highlighting that two other judges had previously withdrawn from participating.
He explained that the case, originating in 2015, was reassigned to Justice Nyako because of its long-standing nature. She has been overseeing the proceedings ever since.

Tsoho believes that Nyako’s familiarity with the case makes her the most suitable judge to continue presiding over it until a conclusion is reached.
Tsoho further explained that if Kanu continues to request Justice Nyako’s recusal at the upcoming hearing, he must file a formal motion on Notice. This must be accompanied by an affidavit outlining the reasons for his request. The prosecution should also be served with this motion before it is presented to Justice Nyako, who will make a decision regarding the matter.
Aloy Ejimakor, Kanu’s special counsel, confirmed the development and mentioned that the legal team is waiting for official communication from the court about the next steps and a new hearing date.
Previously, Justice Nyako had temporarily withdrawn from the case after Kanu, through his lawyer, raised concerns and expressed a lack of confidence in her management of the trial. They accused her of disregarding certain Supreme Court directives.
