Gabriel Suswam, the former governor of Benue State, was dismissed from the Senate by the Court of Appeal in Abuja.
The appeal filed by All Progressives Congress (APC) candidate Emmanuel Udende against the ruling of the Benue State National Assembly Election Petitions Tribunal, which sent Suswam of the Peoples Democratic Party (PDP) back to the Senate, was unanimously upheld by a panel of three justices on Wednesday.
The appellate court determined that the tribunal arrived at an improper conclusion by misanalyzing the evidence that was presented to it.
Udende’s victory in the senate election on February 25 was affirmed by the court, which overturned the tribunal’s ruling. Justice Abimbola Osarugue Obaseki Adejumo gave the verdict.
Remember that Udende defeated Senator Suswam, who received 112,231 votes, with a total of 135,573 votes, according to the Independent National Electoral Commission (INEC).
Suswam filed an appeal with the tribunal, claiming that the election was tainted by excessive voting, anomalies, manipulations, and results fabrication.
