The Appeal Court has overturned a previous judgement regarding PDP delegates in Edo State, marking a significant shift in the party’s internal structure ahead of upcoming elections.
The recent ruling by the Abuja Court of Appeal invalidates a previous decision made by the Federal High Court, which required that 381 ad-hoc delegates be allowed to participate in the February 22 primary election held in Edo State under the People’s Democratic Party (PDP).
As a result of the primary election, Asue Ighodalo has been chosen as the candidate for his party in the forthcoming governorship election slated for September 21st, 2024.
The appellate court, consisting of three members, invalidated Justice Inyang Ekwo’s ruling on July 4th, 2024. The panel contended that the lower court lacked jurisdiction to entertain the lawsuit filed by disgruntled delegates who did not meet the legal requirements for commencing such litigation.
The Court of Appeal, in a unanimous ruling, confirmed the independence of the PDP to choose its candidate for governorship election and declined to intervene.
