Alhaji Abubakar Atiku, the Peoples Democratic Party’s (PDP) presidential candidate, has filed a petition with the Supreme Court asking it to overturn the decision of the Presidential Election Petition Court, which upheld Bola Ahmed Tinubu’s election victory on September 6.
In his Notice of Appeal, Atiku asserted that the tribunal’s findings and judgement in the case challenging Tinubu’s election as president by the Independent National Electoral Commission, INEC, contained grave errors and constituted a miscarriage of justice. The Notice of Appeal was based on 35 grounds.
Atiku’s primary attorney, Chief Chris Uche, SAN, has now filed a Notice of Appeal, asking the Supreme Court to overturn the entire Tribunal’s findings and conclusions because they were not accurate depictions of the reasons for his petition.
The former vice president claimed, among other things, that the Tribunal committed a legal error when it refused to declare the presidential election of February 25, 2023 invalid because it had not been conducted in accordance with the Electoral Act of 2022. According to the evidence presented to the Tribunal, INEC had conducted the election in violation of the Electoral Act’s 2022 principles and in accordance with the “doctrine of legitimate expectation” and had used grave and egregious misrepresentation.
