Gboyega Oyetola, the most recent governor of Osun State, and Benedict Alabi, his running partner, have been recognized as the legitimate candidates for governor of the All Progressive Congress by a court of appeals in Abuja (APC).
Adegboyega Oyetola & Anor v. PDP & Ors was the subject of the appeal with case number CA/ABJ/CV/1099/2022.
The court overturned Justice Emeka Nwite’s decision from the Federal High Court in Abuja on September 30, which disqualified Oyetola and his running mate Alabi from the APC.
The Court emphasized that no party could decide to choose a candidate unlawfully because it is made by party members through congress.
The names of the candidates were provided to INEC by Yobe Governor Mai Buni, but the High Court disregarded Section 183 of the Constitution and Section 82 (3) of the Electoral Act of 2022.
Following the arguments made, Justice Nwite pronounced Oyetola’s candidacy invalid.
Through its attorney Kehinde Ogunwumiju, the PDP filed a lawsuit contesting the nomination and sponsorship of Oyetola and his running companion as the properly nominated candidates of the APC, bringing Buni and four other people before the court.
The court changed its mind on Friday, saying that Mai Bala Buni is immune from suit as a governor and cannot be sued.
