Appeal Court Sets Date to Hear Kano Emirship Dispute

The Court of Appeal has scheduled a date to hear the legal battle over the Kano Emirship dispute, which has drawn significant attention due to its cultural and political implications in the region.

The Abuja Court of Appeal has set a hearing for Thursday, October 17, to address the ongoing emirship dispute in Kano State.

Justice Mohammed Mustapha led a three-member panel of justices that reserved judgment on Monday following the presentation of arguments by lawyers involved in the appeals.

The appellate court is reviewing several appeals, including the case of Alhaji Aminu Ado Bayero versus the Attorney General of Kano State and ten others (Appeal Number CA/KN/166/M/2014), as well as a connected case involving the Kano State House of Assembly and others against Alhaji Aminu Babba Dan Agundi and six additional parties (Appeal Number CA/KN/126/M/2024).

Furthermore, a motion has been filed requesting to halt the execution of the judgment issued on July 25 regarding fundamental rights enforcement.

A Federal High Court in Kano, under the jurisdiction of Justice Abdullahi Liman, has invalidated Governor Abba Yusuf’s decision to depose Emir Ado Bayero and appoint Muhammadu Sanusi II on May 23.

The court also declared the Kano Emirate Council (Repeal) Bill, 2024 as “null and void.” This bill, passed by the Kano State House of Assembly, had invalidated Bayero’s position.

The judge stated that the aforementioned action breaches the court’s previous order, and further noted that “the balance of convenience favors the applicant in this case (Alhaji Aminu Babba Dan Agundi).”

This came after another High Court in Kano State prohibited Ado Bayero from presenting himself as the emir.
