Appeal Court Overturns Elumelu’s Victory in House of Representatives Seat Dispute
The appellate court proclaimed Ngozi Okolie of the Labour Party (LP) as the election’s victor in two rulings.
The ruling by the National and State House of Assembly Election Tribunal in Asaba, which proclaimed Ndudi Elumelu of the Peoples Democratic Party (PDP) as the victor of the most recent election for the Aniocha/Oshimili Federal Constituency of Delta State, has been overturned by the Court of Appeal in Abuja.

The petition Elumelu submitted before the trial tribunal, on which the void judgement was rendered, was dismissed when the tribunal was criticised for invalidating Okolie’s election.
The Court concurred with Mahmud Magaji, the attorney for the Labour Party, that, in contrast to the tribunal’s conclusion, Okolie had been properly nominated and sponsored by his party and had relinquished his position as a Senior Special Assistant to the Delta State Government in accordance with the Constitution.
