Appeal Court in Bayelsa declares Sylva the APC’s nominee for governor

The Federal High Court of Abuja’s October 9 ruling by Justice Donatus Okorowo invalidating Timipre Sylva’s nomination as the All Progressives Congress’ (APC) candidate for the Bayelsa State gubernatorial election on November 11 has been overturned by the Court of Appeal in Abuja.

In a ruling on Tuesday, October 31, a three-person appellate court panel declared that the Federal High Court in Abuja did not have the authority to hear or rule on the matter brought forth by Demesuoyefa Kolomo, who identified himself as an APC member and registered voter.

The court determined that Kolomo lacked the locus standi to petition the court to contest the party’s nominee because he did not participate in the governorship primary.

It then went on to overturn the Federal High Court’s ruling, accept Sylva’s appeal, and provide all of the requested relief.

Additionally, the court granted Sylva a N1 million cost award.

The APC filed a similar appeal on the same point, and the court approved it in a different ruling. The APC was also given N1 million in costs.
