Appeal Court has mandated byelection for the federal constituency of Birniin Kudu, Buji in Jigawa

The lower court’s decision to declare the 2023 election in Jigawa State’s Birnin Kudu/Buji federal constituency inconclusive was upheld by the appellate court located in Abuja.

In his ruling, Justice Ogochuku Anthony Ogakwu, the Chairman of the Appeal Court, mandated that the Independent National Electoral Commission (INEC) hold a byelection at eight polling places in a span of thirty days.

The Peoples Democratic Party (PDP) candidate Adamu Yakubu, who was proclaimed the election winner by INEC, filed an appeal, and the court granted it.

Adamu Yakubu filed a complaint in the Appeal Court, contesting the Election Petition Tribunal’s 2023 declaration of the results of the Birnin Kudu/Buji Federal Constituency election as inconclusive, which was made in Dutse, Jigawa State.

In a previous case, Adamu Yakubu of the Peoples Democratic Party (PDP), who had been proclaimed the winner by the Independent Electoral Commission (INEC), was opposed by Magaji Dau Aliyu of the All Progressives Congress (APC) before the Tribunal.

In a previous ruling, the tribunal presided over by Justice A. Okeke declared that INEC had conducted the election and announced the results of some polling places in violation of the Electoral Act 2022 and the guidelines for election officials for the 2023 election.

INEC is now required by the Appeal Court’s decision to arrange a byelection at the impacted polling places for the federal seat of Birnin Kudu/Buji.
