A second injunction was obtained by the court prohibiting the DSS from detaining, arresting, or obstructing Emefiele’s freedom of travel.
The Department of State Services’ detention and arrest of Mister Godwin Emefiele, the Central Bank Governor who has been suspended, were overturned by another Abuja High Court.
In his ruling, Justice Bello Kawu stated that Mister Emefiele’s arrest, custody, and questioning were in contravention of Justice M. A. Hassan’s directives and the current judgement.
Through his attorney, Peter Abang, Mr. Emefiele requested that the arrest and imprisonment of the applicant be overturned and declared null and void since they were unlawful and rendered meaningless in light of the ongoing judgement from another court that was issued on December 29, 2022.
Justice Kawu also issued an order setting aside any arrest warrants acquired or secured by the Respondents, particularly the DSS, for the arrest of Emefiele in connection with the accusations of funding terrorism, engaging in fraud, laundering money, and posing a threat to the nation’s security made in any court.
The court also issued an order prohibiting the defendants, in particular the DSS, from restricting Mr. Emefiele’s freedom of movement and arresting him.
After much deliberation, the court issued an order of injunction directing and requiring the Respondents, notably the DSS, to immediately release and free Mr. Emefiele from any arrest or detention.
