Olisa Agbakoba, who used to be president of the Nigerian Bar Association (NBA), says that the Constitution doesn’t give the Economic and Financial Crimes Commission (EFCC) the right to look into the financial records of states.
This information was revealed by Agbakoba on Thursday in Lagos State.
He said that the National Assembly had not changed Section 214(1) of the Constitution of the Federal Republic of Nigeria, which establishes the Nigeria Police Force, to include the EFCC’s role.
“So the question is, can the EFCC prosecute state offences if the federal government establishes it?”
“The Supreme Court has concluded that federalism entails two autonomous and separate governments, and if that is correct, the EFCC lacks the jurisdiction to travel to the state and audit their accounts,” the speaker stated.
